The following Terms of Use and Privacy Policy (collectively, the “Terms”) set forth the terms of use governing this website (the “Site”) and the privacy practices of RLM FINSBURY, LLC (“RLM FINSBURY ”) applicable to information submitted to RLM FINSBURY through the Site. Please read the following Terms carefully before you use the Site or submit any information to RLM FINSBURY through the Site. Your use of the Site and/or your submission of any information to RLM FINSBURY through the Site constitutes your agreement to be bound by these Terms without limitation or qualification. By using the Site and/or submitting any information to RLM FINSBURY through the Site you represent that you are over 13 years old.
RLM FINSBURY may modify the Terms from time to time. Modifications shall be effective immediately upon being posted on the Site. No right, title or interest in any Site content or in any trademarks, service marks or company names and logos appearing on the Site is transferred to you as a result of your use of the Site.
3. Site Directed at United States Visitors
The Site is targeted at and intended for visitors residing in the United States. Given the global nature of the Internet, however, the Site may be accessed by visitors residing outside of the United States. We make no representations or warranties that the Site is appropriate or available for use in countries outside of the United States. 5. Limitation of Liability
In no event shall RLM FINSBURY or any other party involved in creating or maintaining the Site or any of its contents be liable for any damages (including, without limitation, direct, incidental, special, consequential, indirect or punitive damages, or damages resulting from lost profits, lost data or business interruption) arising out of your access to, use of or inability to access or use the Site, including without limitation damages to your computer equipment. 6. Injunctive Relief
You acknowledge that any use of the Site except as expressly permitted by these Terms without the prior written permission of RLM FINSBURY will cause irreparable injury for which monetary damages would not be sufficient and you consent to entry of immediate and permanent injunctive relief with respect to such unauthorized use.
7. Indemnification
You agree to indemnify, defend and hold harmless RLM FINSBURY, our parent, WPP Group plc, and all of its subsidiary and affiliated entities, our and their officers, directors, members, agents, employees, consultants, freelancers, independent contractors and representatives to the fullest extent permitted by law from and against any and all actions, proceedings, arbitrations or investigations or threats thereof, losses, expenses, damages, costs and expenses (including reasonable fees, disbursements, and other charges of counsel), resulting from any violation by you of these Terms.
8. Applicable Law
These Terms will be governed by and construed in accordance with the laws of the State of New York, without regard to any principles of conflicts of law. You agree that any action at law or in equity that arises out of or relates to any use of the Site will be filed only in the state or federal courts located in New York County and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.
PRIVACY POLICY
1. Information We Collect
RLM FINSBURY permits users of the Site to submit their resumés, contact information, and certain other personal information (collectively, “Personal Information”) to RLM FINSBURY through the Site. We may also collect tracking data which includes, without limitation, information regarding the number and frequency of visits to the Site, the items and content you view, the websites that you access before and after you visit the Site and your IP address and Internet service provider related information (collectively, “Tracking Data” and together with Personal Information, “Information”).
2. How We Use Your Information
The Information you provide to us is used for RLM FINSBURY’s reasonable business purposes and the purpose for which you provided it, including, without limitation, to contact you for further information and to evaluate resumés submitted to us in contemplation of possible employment or engagement by RLM FINSBURY. In addition, Tracking Data may be analyzed for our reasonable business purposes and so that we can provide you with useful information and can serve you in the best manner possible through enhanced features and functions on the Site.
We may employ outside agents or third-party service providers to operate the Site and employ others to perform functions on our behalf, such as sending postal mail and e-mail and analyzing data. These third parties have access to personally identifiable information needed to perform their functions. We do not authorize these third parties to use your Information for any other purpose.
We may disclose your Information to certain third parties if you have requested or authorized the disclosure of the Information and/or if such disclosure is permitted and/or required by law or to protect the integrity of our services and/or the Site. You hereby authorize us to disclose your Information in those circumstances.
3. Transfer of Information to Third Parties Upon a Change of Control
We retain the right to transfer all Information pursuant to a merger or to a purchaser of RLM FINSBURY or all or substantially all of our assets.
